Introductory Matchmaking Portal Notice
ShareMyHorse operates exclusively as an introductory community directory connecting horse owners with prospective riders and carers. We are not a broker, agent, or party to any horse sharing, loan, or care arrangement. All decisions, safety checks, and agreements are made solely between users.
STATUTORY EQUINE ACTIVITY WARNING (48 U.S. STATES & CANADA)
WARNING: Under the Equine Activity Liability Acts enacted across forty-eight (48) U.S. states and applicable Canadian common law principles, an equine activity sponsor, equine professional, or other person is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.
Participants voluntarily assume all known and unknown risks inherent to working with, riding, and handling equines. See Section 3 below for full state and provincial statutory citations.
1. Our Services
Share My Horse ("Company", "we", "us", or "our") operates the websites https://www.sharemyhorse.com and sharemypony.com. The Services facilitate introductions between equestrians seeking to share, exercise, or collaborate in the care of horses and ponies.
2. Platform Role & Limitations
We are a facilitator only. We do not own, manage, board, train, inspect, or verify any horse, pony, rider, or facility listed on the Services. We do not verify horse soundness, veterinary health, temperament, vaccination records, rider ability, or insurance coverage.
All users are required to conduct independent due diligence, in-person trials, veterinary checks, and reference verifications before undertaking any equine activities.
3. Equine Activity Acknowledgment & Inherent Risks
Horses and ponies are large animals with unpredictable behaviors. You acknowledge that equine activities involve significant inherent risks of bodily injury, permanent disability, and death.
3.1 United States Statutory Protection
Forty-eight (48) U.S. states have enacted Equine Activity Liability Acts (EALAs). Users residing in California and Maryland acknowledge that general common law principles of voluntary assumption of risk and negligence apply.
3.2 Canadian Framework
In Canada, provincial Occupiers' Liability Acts (e.g. Ontario, Alberta, British Columbia), common law principles of volenti non fit injuria, and the Horse Riding Safety Act (Ontario) govern premises and participant liability.
4. Progressive Location Privacy
To protect horse owners, animals, and private facilities, ShareMyHorse enforces a progressive disclosure model:
- Public Browsing: Only the general region (e.g., "Chester County, PA") and an approximate 25-mile radius circle are displayed. Exact street addresses, facility names, and GPS coordinates are strictly filtered out.
- Mutual Interest: A narrower geographic area (~5-mile radius) may be shared upon initiating contact.
- Mutual Agreement (Handshake): Exact street address, barn name, directions, and phone numbers are unlocked ONLY after both parties accept a formal sharing handshake.
5. No Pricing Requirements
Listings on the Services are not required to specify monetary rates. Users may arrange non-monetary exchanges (such as barn chores or caretaking in exchange for riding time). ShareMyHorse does not handle or guarantee payments between users.
6. Prohibited Activities
Users agree not to: misrepresent horse temperament, health, or training; list horses without ownership or authorization; use contact details to trespass on private barns; or scrape portal data. Violations result in immediate account termination.
7. Governing Law & Dispute Resolution
For U.S. residents, these Terms are governed by the laws of the State of Delaware. For Canadian residents, these Terms are governed by the laws of the Province of Ontario. Disputes shall be resolved through binding individual arbitration (AAA or ADRIC).
